Low and Mid-Rise Reforms in NSW: What They Mean for You
As of 1 July 2024, the NSW Government’s low and mid-rise housing reforms are officially in effect, bringing new opportunities for residential development across the state. These changes allow for the development of dual occupancies and semi-detached homes in more R2 low-density residential zones, giving landowners and developers greater flexibility to maximise their property’s potential.
What Are Dual Occupancies and Semi-Detached Homes?
Dual Occupancies are two houses on a single lot, often known as duplexes. They usually feature front and back yards and offer a practical solution for families or investors looking to maximise land use.
Semi-Detached Homes, or “semis,” are side-by-side dual occupancies that have been subdivided, so each dwelling sits on its own lot. This type of home provides independent living spaces while still sharing a common wall.
Where Are These Changes Taking Effect?
The new reforms open up more R2 low-density residential zones for dual occupancies and semi-detached homes. However, certain areas remain excluded, such as land prone to bushfires, flood zones, coastal vulnerabilities, and heritage-listed sites. Specific local government areas like Bathurst Regional Council, City of Blue Mountains, City of Hawkesbury, and Wollondilly Shire Council are also excluded.
What About Complying Development?
Currently, the complying development pathway under the Low-Rise Housing Diversity Code cannot be used in the new R2 zones where dual occupancies and semi-detached homes were previously not permitted. This pause is to give councils time to plan for appropriate settings, such as lot sizes for dual occupancy in their areas.
Future Reforms on the Horizon
The NSW Government has indicated that further low and mid-rise housing reforms will roll out later in 2024. These reforms will expand development possibilities to include townhouses, terraces, and two-storey apartment blocks in R2 low-density zones, and mid-rise apartment blocks near transport hubs in R3 medium-density zones and some employment zones across Greater Sydney, the Hunter, Central Coast, and Illawarra regions.
